1. Who controls your personal data
For this notice, “Factory King”, “we”, “us” and “our” refer to Factory King as the operator of https://factoryking.my. Factory King is the data controller for personal data handled through this website and is represented for enquiries by Kher, Registered Real Estate Negotiator REN 82709.
Our operating location is Puchong, Selangor, Malaysia. You can reach us at hello@factoryking.my or +60 12-786 8599. This notice is intended to meet the notice and choice requirements of Malaysia’s Personal Data Protection Act 2010 (“PDPA”), as amended from time to time.
2. Personal data we may collect
The data we collect depends on how you use the website and what you ask us to do. We may collect:
- Identity and contact details, such as your name, company, phone or WhatsApp number and email address.
- Property requirements, such as whether you wish to buy, rent, sell or lease, preferred area, budget, property reference, intended use, size, timing and other requirements in your message.
- Communications and service records, including messages, call or viewing details, follow-up preferences and documents that you voluntarily provide for an enquiry or transaction.
- Technical information processed when the site is delivered, such as IP address, browser and device type, requested pages, timestamps, referring page and diagnostic or security logs.
- Website activity recorded by advertising and analytics tools, such as pages and property pages viewed, property filters used and WhatsApp, phone or email links tapped (see section 9).
- Relevant information received lawfully from a person who refers you, an organisation you represent, property owners or developers, cooperating property professionals, and public or authorised sources.
3. How we collect personal data
We collect personal data directly from you when you complete a form, send a WhatsApp message or email, call us, arrange a viewing, provide property information or otherwise communicate with us. We may also receive it from the sources listed above where this is relevant and lawful.
Some technical data is generated automatically by your browser, our hosting or security providers, and external resources used by the website. Section 9 explains these website technologies in more detail.
4. Why we use personal data
We process personal data only for purposes directly related to our services, where you have consented or where processing is otherwise permitted or required by applicable law. Those purposes may include:
- Responding to your enquiry, confirming requirements, preparing a shortlist, arranging viewings and following up on a service you requested.
- Providing relevant property information, availability updates and market information connected with your stated requirements.
- Supporting negotiations, listings, introductions and the administration of a potential or completed property transaction.
- Maintaining accurate enquiry and relationship records, handling complaints and establishing, exercising or defending legal rights.
- Protecting the website, detecting abuse, troubleshooting and maintaining service reliability.
- Meeting legal, regulatory, professional, accounting or reporting obligations.
- Improving our website and services using aggregated or de-identified information where reasonably possible.
- Measuring the results of our advertising, and showing Factory King advertisements on other platforms to people who have visited this website.
5. What is required and what is optional
On the website enquiry form, fields marked with an asterisk are required. At present these are your name, phone or WhatsApp number, enquiry type and preferred area. Without them, we may be unable to identify your request, reply or prepare a relevant shortlist.
Company name, email, budget and a detailed message are optional on the form unless they later become reasonably necessary for the service you request. You may choose another available contact channel instead of the form, but refusing to provide necessary data may limit the service we can provide.
6. Enquiry forms, WhatsApp, email and calls
Depending on the site configuration, an enquiry may be delivered through a form-delivery provider or prepared as a WhatsApp message on your device. If WhatsApp opens, the message is not sent to us until you choose to press Send in WhatsApp.
When you use WhatsApp, email or telephone services, the relevant provider processes communications and account or technical data under its own privacy terms. Avoid sending identity documents, banking details or other sensitive information through ordinary messages unless we have confirmed that it is necessary and agreed on an appropriate channel.
7. Who we may disclose personal data to
We disclose only what is reasonably necessary for the stated purpose. Depending on your request, recipients may include:
- Kher and authorised personnel or advisers who need the information to handle your enquiry.
- Property owners, landlords, developers, vendors, prospective buyers or tenants, and cooperating registered agencies or negotiators where an introduction, viewing, listing or transaction requires it.
- Service providers that support hosting, security, email, form delivery, communications, document handling or other operational functions.
- Lawyers, accountants, valuers, financiers or other professional advisers when you request their involvement, consent to it, or it is otherwise necessary and lawful.
- Regulators, courts, law-enforcement bodies or other persons where disclosure is required or authorised by law, or reasonably necessary to protect rights, safety and security.
We do not sell, rent or trade personal data. We do not disclose your direct contact details to a property counterparty merely for convenience where the same purpose can reasonably be achieved with less data.
8. Overseas processing and external services
Some providers, including Google, Meta and WhatsApp, may process data on infrastructure outside Malaysia. A hosting, email or form-delivery provider may do the same. Where personal data is transferred outside Malaysia, we will handle the transfer in accordance with applicable PDPA requirements and take reasonable steps appropriate to the service and data involved.
External services have their own privacy notices and security practices. Their role may be independent of Factory King when you choose to open or use their service.
10. How long we keep personal data
We retain personal data only for as long as reasonably necessary to handle the enquiry or service, maintain an ongoing business relationship, meet legal, regulatory, professional or accounting obligations, resolve disputes and enforce agreements. The period varies with the nature of the record and whether a transaction proceeds.
We periodically review records and delete, securely dispose of or anonymise personal data when it is no longer required. Factory King does not receive or retain your browser shortlist merely because you save a property. Third-party providers may retain data under their own documented schedules and legal duties.
11. Security and data breaches
We use reasonable administrative, technical and organisational measures appropriate to the nature of the data to protect it against loss, misuse, alteration and unauthorised access or disclosure. Access should be limited to people and providers who need it for an authorised purpose.
No website, messaging platform or electronic transmission is completely secure. If a personal data breach occurs, we will assess it and make notifications required by applicable law without representing that every incident can be prevented.
12. Your choices and rights
Subject to the PDPA, its exceptions and any verification reasonably required, you may:
- Ask whether we process your personal data and request access to it.
- Ask us to correct personal data that is inaccurate, incomplete, misleading or not up to date.
- Withdraw consent for future processing where processing depends on consent.
- Ask us to stop direct marketing, or to stop processing likely to cause unwarranted damage or distress.
- Ask us to delete or stop using data that is no longer required, subject to lawful recordkeeping or other permitted grounds for retention.
- Request transmission of personal data to another data controller where the statutory right to data portability applies and the transfer is technically feasible and compatible.
A withdrawal or deletion request does not affect processing already carried out lawfully and may limit our ability to continue a service. We may retain a minimal record where necessary to honour an opt-out, comply with law or defend legal claims.
13. Children’s data
This website and our industrial-property services are not directed to people under 18. We do not knowingly ask children to submit personal data. A parent or guardian who believes a child has provided data should contact us so that we can review and, where appropriate, remove it.
14. Updates, requests and complaints
We may update this notice when our services, technology or legal obligations change. The revised version will be posted here with a new “Last updated” date, and we will use a reasonable additional notice where a change materially affects how personal data is handled.
To exercise a right or raise a privacy question, use the contact details below and describe your request. If a concern is not resolved, you may also contact or lodge a complaint with Malaysia’s Personal Data Protection Commissioner through its official channels.
